<p>De Berti Jacchia can boast one of the longest established and best known IP practices in Italy, in particular in the patent and trademark areas, with special emphasis on the pharma and life sciences, fashion and luxury and durable consumer goods industries. YUS is one of the main IP firms active in the <strong>Russian Federation</strong> and the <strong>CIS</strong> jurisdictions since more than 20 years, with a dedicated team of Russian and Eurasian lawyers and patent and trademark attorneys encompassing a full range of expertise on patents and trademarks, domain names, copyright, industrial secrets, filing and prosecution, software protection and digital contents, technology transfers, customs protection and litigation. Both firms know each other well and collaborate since long in the IP sector through the Moscow office of De Berti Jacchia, and intend to invest on their synergies.</p>

The draft law “On amendments to the RF Competition Law and other legislative acts”, so-called “fifth antimonopoly draft” (“Draft”), was published for a public consultation that came to an end on April 24, 2018. The Draft is aimed at improving the antimonopoly governance in the context of digital economy. Among other innovations, the Draft seeks to eliminate the immunities provided by Russian antimonopoly law in the area of intellectual property. We consider below this particular provision of the Draft in the light of the existing antimonopoly legislation, the recent RF Constitutional Court ruling on parallel imports and prevailing legal thinking on the subject&#8230;</p>

The RF Constitutional Court provided a new interpretation of the principle of exhaustion of trademark rights and parallel importations in its Judgement dated February 13, 2018 following a complaint filed by the Russian entity OOO “PAG”. The latter contested the constitutionality of the RF Civil Code provisions which establish the principle of national exhaustion of trademark rights and civil liability for parallel importers along with other legal consequences. The Judgement now allows the Courts to deny the application of the consequences of parallel importation in cases where the unfair behavior of the trademark holder may threaten the public interest. Moreover, the Judgement prohibits the imposition of civil sanctions for parallel importations of unlawfully imitated goods. We provide below a general overview of the case, the Russian exhaustion principle and the Judgement&#8230;</p>

So far, atypical registrations in Russia have consisted of rare examples of sound, light, holographic, position, motion and single colour or combination of colours trademarks. Registration of the more exotic taste and smell trademarks, never took place and remained an unexplored challenge&#8230;</p>

So far, telecom operators, hosting providers, website owners and search engine operators would have to block access to or remove the infringing content following a judicial ruling accompanied by a request from the Russian Information and Technology Authority (Roskomnadzor)&#8230;</p>

It is similarly uneasy to do without them when enforcing intellectual property rights on the Internet. In 2017, the Russian legislator started familiarizing itself with this tool, and as a result extended, to a certain degree, the technical possibilities for protecting intellectual property rights from violations put in place through the Internet (e.g. on Google Russia, Yahoo Russia, and national operators Yandex, Rambler and Mail.ru)&#8230;</p>
